Taqueria De Anda BIG GAME Giveaway Sweepstakes Official Rules

NO PURCHASE OR PAYMENT NECESSARY TO ENTER TO WIN. A PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING.

1. Eligibility: Taqueria De Anda BIG GAME Giveaway Sweepstakes (the “Sweepstakes”) is open only to individuals who are legal residents of California who are licensed drivers and at least eighteen (18) years old at the time of entry. Employees, officers and directors (including immediate family members (spouse, parent, child and sibling and their respective spouses, regardless of where they reside) and members of the same household, whether or not related) of Taqueria De Anda, and each of their respective parent, affiliated companies, subsidiaries, licensees, distributors, dealers, retailers, printers and advertising and promotion agencies, and any and all other companies associated with the Sweepstakes are not eligible to participate or win a prize. The Sweepstakes is subject to all applicable federal, state, and local laws and regulations. Void outside of California and where prohibited. Participation constitutes entrant’s full and unconditional agreement to these Official Rules and Sponsor’s decisions, which are final and binding in all matters related to the Sweepstakes. Winning the prize is contingent upon fulfilling all requirements set forth herein.
2. Sponsor: Taqueria De Anda (Pomona.) -1690 S. Garey Avenue, Pomona, CA 91766. For a reasonable period of time following the Sweepstakes, you may obtain the name of the winners by requesting such information in writing to Sponsor at that address.
3. Timing: Entries for the Sweepstakes may be submitted beginning January 3, 2012 at 10:01 a.m. Pacific Time (“PT”) and ending at January 31, 2012 at 11:00 p.m. PT (the “Promotion Period”). All entries must be received during the Promotion Period.
4. How to Enter: You can enter the contest through the following three (3) methods: Method 1: During the Promotion Period, visit Taqueria De Anda (Pomona) Facebook page, “Like” the page, and post a comment on Taqueria De Anda (Pomona’s) Facebook
wall regarding your favorite football team. All entries become the property of the Sponsor and will not be acknowledged or returned. In the event a dispute regarding the identity of the individual who actually submitted an entry cannot be resolved to Sponsors’ satisfaction, the affected entry will be deemed ineligible. Method 2: During the Promotion Period, Follow Taqueria De Anda (Pomona) on Twitter @TacoRant and post a Tweet using hashtag #biggamegiveaway. Method 3: During the Promotion Period, print your name, address, e-mail address, phone number, and date of birth, on a 3×5 card in an envelope with first-class postage affixed and mail (or hand deliver) to: Taqueria De Anda BIG GAME Giveaway Sweepstakes, 1690 S. Garey Avenue, Pomona, CA 91766. Mailed entries must be mailed in sufficient time to be received by 11:00 p.m. PT January 31, 2011. Lost, late, illegible or misdirected entries will not be accepted.
5. Drawings: Sponsor will conduct the administration and operation of the Sweepstakes. Sponsor’s decisions regarding administration and operation and the selection of the potential winner are final and binding in all matters related to the Sweepstakes. Sponsor will randomly select the potential winner from all eligible entries received on or around January 31, 2011. The potential winner will be noticed by email, mail or phone. Potential winner must comply with all terms and conditions of these Official Rules, and winning is contingent upon fulfilling all such requirements. In the event that a potential winner is disqualified for any reason, Sponsor will award the prize to an alternate winner by random drawing from among all remaining eligible entries. Only three (3) alternate drawings will be held, after which the prize will remain un-awarded.
6. Prize: THREE (3) GRAND PRIZES: Taqueria De Anda will provide ingredients to produce approximately 120 standard sized Taqueria De Anda beef, chicken, or pork tacos. Prizes are awarded “AS IS” WITH NO WARRANTY OR GUARANTEE, INCLUDING, WITHOUT LIMITATION, ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. Winner must take delivery of prize from the restaurant, and within a reasonable time period, both designated by Sponsor. Approximate Retail Value: $70. All details determined by Sponsor, in its sole discretion. Prize is non-transferable and no substitution will be made except as provided herein at the Sponsor’s sole discretion. Sponsor reserves the right to substitute the prize for one of equal or greater value if the designated prize should become unavailable for any reason. Winner is responsible for all taxes and fees associated with prize receipt and/or use. Odds of winning depend on the number of eligible entries received during the Promotion Period.
7. Release: By participating in the Sweepstakes and submitting an entry, each entrant agrees to fully release and hold harmless Sponsor and each of their respective parents, subsidiaries, affiliates, officers, directors, employees, agents, licensees, dealers, retailers, printers, representatives, suppliers, distributors, advertising and promotion agencies, prize suppliers, and any and all other companies associated with the Sweepstakes, and all of their respective parent companies, officers, directors, employees, representatives and agents (collectively, the “Released Parties”) from and against any claim or cause of action, including, but not limited to, personal injury, death, or damage to or loss of property that may occur, directly or indirectly, in whole or in part, arising out of participation in the Sweepstakes or from the receipt, use or misuse of any prize, including any travel or activity related thereto.
8. Publicity: Each winner, by acceptance of prize, grants to Sponsor and each of its respective designees the right to publicize such winner’s name, photograph, voice, statements, address (city and state of residence) and/or other likeness and prize information for promotional purposes in any media now known or hereafter devised, worldwide, in perpetuity, without further payment or consideration, notification or permission, except where prohibited by law.
9. General Conditions: Sponsor reserves the right to cancel, suspend and/or modify the Sweepstakes, or any part of it, if any fraud, technical failures or any other factor impairs the integrity or proper functioning of the Sweepstakes, or any part of it, as determined by Sponsor in its sole discretion. Sponsor reserves the right, in its sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes or to be acting in violation of these Official Rules or any other promotion or in an unsportsmanlike or disruptive manner. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
10. Limitations of Liability: The Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by entrants, printing errors or by any of the equipment or programming associated with or utilized in the Sweepstakes; (2) technical failures of any kind; (3) unauthorized human intervention in any part of the entry process or the Sweepstakes; (4) technical or human error which may occur in the administration of the Sweepstakes or the processing of entries; or (5) any injury, loss or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Sweepstakes or receipt or use or misuse of any prize.
11. Disputes: By participating in the Sweepstakes and submitting an entry, each entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by arbitration in the entrant’s or winner’s individual capacity, and not as a plaintiff or class member in any purported class or representative proceeding. Such arbitration shall be conducted within the State of California before the American Arbitration Association in accordance with the Supplementary Procedures for Consumer-Related Disputes of the Commercial Arbitration Rules and the Consumer Due Process Protocol of the American Arbitration Association. In such proceeding, the arbitrator may not consolidate more than one person’s claims, and may not otherwise preside over any form of a representative or class proceeding. (2) Any and all claims, judgments and awards shall be limited to actual out-of-pocket
costs incurred, including costs associated with entering this Sweepstakes, but in no event including attorneys’ fees; and (3) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the entrant and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of California without giving effect to any choice of law or conflict of law rules (whether of the State of California or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of California.
12. Entrant’s Personal Information: The information that you provide in connection with the Sweepstakes may be used for Sponsor’s internal purposes and to send you information about Sponsor’s products and offers, but will not be provided to third parties, except as necessary for the administration of Sweepstakes may be required by law or legal process. Any information collected will be subject to Sponsor’s Privacy Policy, located at http://thetaqueriadeanda.com/privacy.php (the “Policy”). By entering the Sweepstakes, you acknowledge that you have agreed to such Policy and you consent to the collection, use and disclosure of your personal information for the purposes of administering this Sweepstakes in accordance with such Policy.
